Terms and conditions

Please read and review this Legal Statement carefully before accessing or using this website (the “Site”). By accessing or using this Site, you acknowledge that you have read, understood, and agreed to this Legal Statement. (the “Site”) is owned and operated by DTV. DTV reserves the right to modify these Terms and Conditions, so it is important to check them periodically.

1. Agreement

1.1 By agreeing to enrol in the course on this website, the Client agrees to enter into a commitment with DTV and to abide by the Terms and Conditions as stated herein.

1.2The agreement will commence once the Client has agreed to the terms and conditions as stated herein, the request to enrol has been confirmed by DTV, and the invoice sent by DTV has been paid in full. DTV will directly confirm the agreement by sending an email to the email address submitted on the application form.

1.3 DTV will not accept applications without a fully completed  application form.

1.4 DTV shall review applications and enrolment requests in order of submission.

2. Payment and Invoices

2.1 Fees are subject to annual change. All fees are exclusive of taxes (BTW), levies, or duties imposed by taxing authorities unless otherwise stipulated.

2.2 The Client must settle the invoice in full within the payment term stated on the invoice. The enrolment will only be considered final once the invoice has been paid in full.

2.3 If the Client fails to remit payment within the terms indicated in clause 2.2 he shall be legally in default. If the Client, after the expiration of the payment terms, fails to settle the invoice, DTV shall send a payment reminder to the Client. DTV is entitled, starting from the date of default by the Client, to charge interest over the owed amount. The Client shall also be responsible for any judicial and/or extrajudicial collection costs.

3. Amendments and Renewals

3.1  To facilitate timely communication, the Client must enrol at least six (6) weeks prior to the commencement of the course or service offered by DTV Consultants. DTV reserves the right to cancel or continue the training course of service up to three (3) weeks prior to  commencement.

3.2 If the Client has enrolled in a training course or other service by DTV and wishes to cancel, the following cancellation terms apply:

       3.2.1 The Client may only cancel in writing and email.

       3.2.2 The Client may cancel their enrolment free of charge up to six (6) weeks prior to commencement of the training course or other service offered by DTV. In this case, any amount already paid will be refunded.

       3.2.3 If the Client has not cancelled their enrolment within the time frame specified by section 3.2.2., cancellation is no longer possible. The enrolment may, however, be transferred to an associate or other individual within the organisation.

3.3 DTV reserves the right to postpone, cancel, or change the dates of the training courses due to insufficient enrolments, capacity constraints, and unforeseen or special circumstances. DTV does not accept liability for claims, liabilities, and damages arising directly or indirectly out of this procedure.

4. Liability

4.1 DTV’s liability is limited to the amount the Client has paid for DTV’s services.

4.2 DTV reserves the right to refuse or discontinue service and does not tolerate fraudulent conduct, harassing or disrespectful behaviour, images, messages, or interactions by any Client, in any form, at any aspect of the programme.

4.3 All materials pertaining to the training courses and services supplied by DTV have been carefully selected, designed, and developed. DTV is not responsible and will not accept liability for any possible erroneous information or omissions in the supplied materials unless gross negligence or demonstrably wilful intents on DTV’s part are existent and proven.

5. Privacy

5.1 DTV will process any data provided in completing the online registration, application or enquiry forms, and any further forms containing company and personal details. This data is used for customer and operational management such as enrolling Clients in training courses, sending training materials, and the distribution of any related information.

5.2 DTV may pass on your information to the following third parties:

5.2.1 GO-bility, co-organiser

5.2.2 Individuals directly involved in guiding our clients, e.g. coaches and instructors.

5.3 DTV may be obliged or permitted to disclose your personal data by law and may pass on your information and data if the Company has a legal obligation to do so, or if the Company must enforce or apply its terms of use or other agreements.

5.4 Clients reserve the right to access, edit, correct, or update their information provided to DTV. Clients who no longer wish to receive our communications may opt out of receiving these communications by notifying  DTV in writing.

5.5 DTV is committed to data protection and privacy and abides by the Dutch Data Protection Act (CBP/WBP).

6. Copyright

6.1 Materials supplied during the course are intended exclusively for personal use by course participants. It is expressly forbidden to copy, reproduce, disseminate, transmit, use, or modify any of the material without prior written permission of DTV and GO-Bility.
